1. Acceptance of Terms

Welcome to Jen. By accessing or using our AI image generation service ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use our Service.

These Terms constitute a legally binding agreement between you and Jen ("we," "our," or "us"). We reserve the right to modify these Terms at any time. Your continued use of the Service after changes constitutes acceptance of the modified Terms.

2. Eligibility and Account Registration

2.1 Age Requirements

  • You must be at least 13 years old to create an account
  • Users aged 13-17 must have parental or guardian consent
  • We reserve the right to verify age and parental consent
  • Accounts created in violation of age requirements will be terminated

2.2 Account Security

  • You are responsible for maintaining the confidentiality of your account credentials
  • You must notify us immediately of any unauthorized access to your account
  • You are responsible for all activities that occur under your account
  • We are not liable for any loss or damage from unauthorized account access

2.3 Account Information

  • You must provide accurate and complete registration information
  • You must promptly update your information if it changes
  • Providing false information may result in account termination

3. Acceptable Use Policy

3.1 Permitted Uses

You may use Jen to:

  • Generate family-friendly, safe, and appropriate images
  • Create content for personal, educational, or commercial projects (subject to licensing)
  • Share generated images in compliance with these Terms

3.2 Prohibited Uses

You may NOT use Jen to generate, upload, or share content that:

  • Illegal Content: Violates any applicable local, state, national, or international law
  • Harmful to Minors: Contains child sexual abuse material (CSAM) or sexualizes minors in any way
  • Adult/Sexual Content: Contains pornography, nudity, or sexually explicit material
  • Violence: Depicts graphic violence, gore, or cruelty
  • Hate Speech: Promotes hatred, discrimination, or harassment based on race, ethnicity, religion, gender, sexual orientation, disability, or other protected characteristics
  • Harassment/Bullying: Targets, threatens, or harasses individuals or groups
  • Misinformation: Creates deepfakes, misleading content, or impersonates others without consent
  • Intellectual Property: Infringes on copyrights, trademarks, or other intellectual property rights
  • Privacy Violations: Uses others' personal information without authorization
  • Spam/Fraud: Creates content for spam, phishing, fraud, or malicious purposes
  • Harmful Activities: Promotes dangerous activities, self-harm, or illegal substances
  • Political Manipulation: Creates misleading political content or deepfakes of public figures

3.3 Technical Restrictions

You may NOT:

  • Reverse engineer, decompile, or attempt to extract the source code of our Service
  • Use automated tools (bots, scrapers) without written permission
  • Bypass rate limits, security measures, or access controls
  • Interfere with or disrupt the Service or servers
  • Use the Service to develop competing products
  • Resell or redistribute the Service without authorization

4. Content Ownership and Licensing

4.1 Your Content

  • You retain ownership of text prompts you create
  • You grant us a worldwide, non-exclusive license to use your prompts to generate images and improve our Service
  • You represent that you have all necessary rights to the content you provide

4.2 Generated Images

  • You own the images you generate, subject to these Terms
  • You may use generated images for personal and commercial purposes
  • You must not use images in ways that violate these Terms or applicable law
  • We reserve a non-exclusive license to use generated images for marketing, improvement, and research purposes
  • AI-generated content may not be copyrightable under current US law; consult legal counsel for specific use cases

4.3 Attribution

  • Attribution to Jen is appreciated but not required for personal use
  • Commercial use may require attribution depending on your subscription plan

5. Subscription and Payments

5.1 Subscription Plans

  • We offer various subscription tiers with different features and usage limits
  • Pricing and features are subject to change with notice
  • Free tier users may have limited access to features and image generation capacity

5.2 Billing

  • Subscriptions are billed on a recurring basis (monthly or annually)
  • You authorize us to charge your payment method automatically
  • Failed payments may result in service suspension or downgrade
  • You are responsible for all applicable taxes

5.3 Refunds

  • Refunds are provided at our discretion
  • Unused credits or subscription time is generally non-refundable
  • Contact support within 14 days of purchase to request a refund
  • Refunds for violations of these Terms are not provided

5.4 Cancellation

  • You may cancel your subscription at any time
  • Cancellation takes effect at the end of the current billing period
  • You will retain access until the end of the paid period
  • No refunds for partial periods unless required by law

6. Content Moderation and Enforcement

6.1 Automated and Manual Review

  • We use automated systems and manual review to detect violations
  • We reserve the right to review all content generated through our Service
  • Flagged content will be reviewed by our moderation team

6.2 Enforcement Actions

Violations may result in:

  • Content removal
  • Account warnings
  • Temporary suspension
  • Permanent account termination
  • Legal action and reporting to authorities (for serious violations)

6.3 Appeals

  • You may appeal moderation decisions through our support system
  • Appeals will be reviewed within 7 business days
  • Our decision on appeals is final

7. Intellectual Property

7.1 Our Intellectual Property

  • The Service, including software, design, trademarks, and branding, is our property
  • You may not use our trademarks without written permission
  • These Terms do not grant you any intellectual property rights except as explicitly stated

7.2 DMCA and Copyright Complaints

If you believe content infringes your copyright:

  • Submit a DMCA takedown notice to dmca@jen.ai
  • Include: identification of the copyrighted work, the infringing material, your contact information, and a good faith statement
  • We will respond according to the Digital Millennium Copyright Act
  • Repeat infringers will have their accounts terminated

8. Privacy and Data Protection

Your use of the Service is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Service, you consent to our data practices as described in the Privacy Policy.

9. Disclaimers and Limitations of Liability

9.1 Service Availability

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND.

  • We do not guarantee uninterrupted or error-free service
  • We may modify, suspend, or discontinue the Service at any time
  • Scheduled and emergency maintenance may cause temporary unavailability

9.2 Disclaimer of Warranties

WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING:

  • Warranties of merchantability, fitness for a particular purpose, and non-infringement
  • Warranties regarding accuracy, reliability, or quality of generated images
  • Warranties that the Service will meet your requirements

9.3 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

  • WE ARE NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES
  • OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM
  • THIS LIMITATION APPLIES TO ALL CLAIMS, INCLUDING BREACH OF CONTRACT, TORT, OR STATUTORY CLAIMS

9.4 AI Limitations

  • AI-generated content may contain errors, biases, or unexpected results
  • We are not responsible for how you use or rely on generated content
  • You should review and verify all generated content before use

10. Indemnification

You agree to indemnify, defend, and hold harmless Jen, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

  • Your use of the Service
  • Your violation of these Terms
  • Your violation of any third-party rights
  • Content you generate or share

11. Dispute Resolution

11.1 Governing Law

These Terms are governed by the laws of the State of [Your State], United States, without regard to conflict of law principles.

11.2 Arbitration

Any disputes arising from these Terms or the Service shall be resolved through binding arbitration in accordance with the American Arbitration Association's rules, except where prohibited by law.

  • Arbitration will be conducted on an individual basis only
  • You waive your right to participate in class actions or class arbitrations
  • Small claims court remains available for qualifying disputes

11.3 Exceptions

Either party may seek injunctive relief in court to prevent infringement of intellectual property rights.

12. Termination

12.1 Termination by You

  • You may terminate your account at any time through account settings
  • Termination does not relieve you of payment obligations for the current billing period

12.2 Termination by Us

We may suspend or terminate your account:

  • For violations of these Terms
  • For suspected fraudulent or illegal activity
  • For non-payment
  • At our discretion with or without cause

12.3 Effect of Termination

  • You will lose access to your account and generated content
  • We may delete your data according to our retention policies
  • Provisions that should survive termination (e.g., indemnification, limitations of liability) will remain in effect

13. Export Controls

You may not use the Service in violation of US export control laws. You represent that you are not located in a country subject to US embargo and are not on any US government restricted parties list.

14. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect.

15. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Jen regarding the Service, superseding any prior agreements.

16. No Waiver

Our failure to enforce any provision of these Terms does not constitute a waiver of that provision or any other provision.

17. Assignment

You may not assign these Terms without our written consent. We may assign these Terms without restriction, including in connection with a merger or acquisition.

18. Force Majeure

We are not liable for any failure to perform due to circumstances beyond our reasonable control, including natural disasters, war, terrorism, riots, embargoes, government actions, or internet service provider failures.
